Terms & Conditions for Consignment Sales

1. Service Description

By engaging this service, the Client authorises Victoria Fearnley and Surrey Decluttering to sell pre-approved items on their behalf via third-party online platforms. The service includes:

  • Photography and listing creation
  • Basic research and pricing guidance
  • Handling buyer enquiries
  • Coordination of shipping or local pickup
  • Monitoring and management of listings

2. Item Acceptance Criteria

  • Only items that are new or in good, resellable condition, and have a minimum resale value of £10, will be considered.
  • Surrey Decluttering reserves the right to refuse any item deemed inappropriate, damaged, unsafe, or unlikely to sell.
  • Items must be clean, functional, and legal to sell under UK law.
  • The Client confirms they are the legal owner of all items submitted for consignment and have the authority to sell them.
  • A photo inventory may be created at intake for mutual records upon request.

3. Pricing & Listing Terms

  • Pricing will be based on current market research and platform demand.
  • Clients may suggest a minimum acceptable sale price, which will be taken into account. However, Surrey Decluttering retains final authority on listing price to optimise sale potential.
  • In cases where pricing needs urgent adjustment (e.g. clearance), Surrey Decluttering will make reasonable efforts to inform the client.
  • Listings will remain active for up to 3 months unless agreed otherwise in writing.

4. Commission & Fees

  • Surrey Decluttering retains a 40% commission on the final sale price.
  • All platform selling fees, payment processing fees, and shipping costs will be deducted from the final amount received by the Client.
  • Optional services (e.g. professional cleaning or repairs) may be offered at an additional fee, quoted and agreed in writing in advance.

Example Breakdown:

Sale Price: £100

Commission (40%): £40

Platform Fees: £2

Shipping: £3.39

Client Receives: £54.61

5. Payout Terms

  • Payouts will be made via Bank Transfer.
  • Payment will be processed within 2 weeks of either:
    • The final item being delivered and any platform return/refund window closing, OR
    • 3.5 months from the date of item listing
      (whichever occurs first).
  • Clients may request a summary of sold items upon payout.

6. Returns, Platform Policies & Liability

  • Some platforms (e.g. eBay) allow buyers to return items within a defined window. The Client acknowledges and accepts that platform-specific return policies apply and returns may occur without prior notice.
  • If an item is returned:
    • It may be relisted or returned to the Client.
    • No commission will be paid on returned items.
    • If return shipping or platform fees are incurred due to a faulty, misdescribed, or non-functioning item, these costs will be deducted from the Client’s payout.
  • Surrey Decluttering is not liable for loss, damage, or theft once the item is handed to a courier or buyer.
  • While all reasonable care will be taken while items are in Surrey Decluttering’s possession, the service does not offer insurance. The Client is encouraged to insure high-value items independently.

7. Unsold Items

  • Items that remain unsold after 3 months may:
    • Be returned to the Client at their expense, OR
    • Be donated or responsibly disposed of, as agreed in advance.
  • If no response is received from the Client within 30 days of notice of unsold items, they will be donated to charity.
  • Clients must collect returned items from:
    9 Furnival Close, Virginia Water, GU25 4HR
    (unless otherwise agreed).

8. Termination of Agreement

  • Either party may terminate this agreement at any time with 5 days’ written notice.
  • Upon termination, unsold items will be managed as per Section 7 above.
  • Any sales completed before termination will still follow the agreed payout terms.

9. Governing Law & Dispute Resolution

  • These Terms and Conditions are governed by the laws of England and Wales.
  • Both parties agree to attempt informal resolution of any disputes before pursuing formal legal action.

10. Privacy & Data Protection

  • Surrey Decluttering will handle all personal information in accordance with UK GDPR.
  • Data (such as your name, contact details, bank information) will only be used to provide this service and will not be shared with third parties, except as required to process sales or by law.
  • Clients may request to view or delete their personal data at any time.

11. Agreement & Client Instructions

By signing or confirming these Terms (in writing, email, or verbally), the Client acknowledges they have read, understood, and accepted the above conditions, and authorises Surrey Decluttering to act as a third-party seller on their behalf.
